Own an HDB Flat and Buying an EC: How the 6-Month Disposal Deadline Works

If you or anyone in your EC application owns an HDB flat, you have to dispose of it within six months. That sounds generous until you add up how long an HDB resale actually takes, and notice that HDB’s own pages word the starting point in two different ways. Here is how the deadline is measured and how to plan backward from it.

The rule

HDB’s conditions after buying an EC say you, or any person listed in the application, must dispose of any interest in any HDB flat within 6 months, and that this is based on the legal completion date of the disposal. That means the date the sale completes, not the date you grant an option or agree a price.

It covers everyone listed in the application. If a parent or a spouse has an interest in a flat, that interest has to go as well.

The clock has two start points on HDB’s pages

HDB pageWording
Conditions After Buying an ECWithin 6 months from key collection of the EC unit
Eligibility for Buying an ECWithin 6 months of completing your EC unit purchase

Both pages say the disposal is measured by its legal completion date.

Which date comes first depends on your project’s handover timeline. Until HDB confirms your deadline in writing, treat the earlier of the two as your deadline. HDB’s pages do not set out what happens if you miss it, so do not plan around leniency.

Working backward from the deadline

HDB’s resale process gives you each stage’s timing. Add them up and the six months shrink fast:

  1. Grant an Option to PurchaseThe buyer has 21 calendar days, including weekends and public holidays, to exercise it.
  2. Buyer exercises the OTP; both sides submit the resale applicationThe second party must submit within 7 calendar days of the first, or the application lapses and you restart.
  3. HDB accepts the applicationHDB says it will notify you of acceptance within 28 working days if the application is in order.
  4. Processing and completionAbout 8 weeks from the date of HDB’s acceptance. The completion date in the acceptance letter is the earliest possible date.

Taking each stage at its longest, that is about four months from the day you grant the OTP to completion, before you have found a buyer. Not every stage runs to its maximum, but the deadline does not flex. Plan to have your flat on the market at least six months before the date you are working to, and earlier if you want room to negotiate or re-list.

Do the dates for your own project. PropLeh’s EC key dates tool works backward from your key collection date and shows the latest dates for each stage, using the timings above.

Selling early instead

Nothing stops you selling your flat before the EC is finished, provided your flat’s own MOP has ended. If your flat is still within its MOP when the deadline arrives, you cannot sell it, so check your MOP date on MyHDB Page well before key collection.

Selling early makes the deadline irrelevant but creates a housing gap. HDB’s temporary extension of stay lets a seller stay up to 3 months after completion, but the seller must have committed to a completed property, which does not fit an uncompleted EC. See the extension rules. Plan for rent in between.

Why this is an HDB clock, not an ABSD clock

With a new EC there is no ABSD to refund. IRAS fully remits ABSD on a new EC unit when any purchaser is a Singapore Citizen. The clock you are working to is HDB’s, not IRAS’s. It is different from buying a resale EC or a private home while holding an HDB flat, where ABSD is paid first and refunded only if you sell within six months. See the bridging loan guide for how those cases differ.

What the sale pays out

When an HDB flat with a bank loan is sold, the proceeds go first to discharge the loan, then to refund the CPF money used with interest. What remains is your cash, which you can put towards the EC’s later payments and costs, since the 20% downpayment was paid long before. Use the Sale Proceeds Calculator and read how CPF accrued interest reduces what you take home.

FAQ

Does the 6 months start from TOP?

No. HDB’s pages refer to key collection and to completing the EC purchase. TOP is the date the EC’s MOP starts counting, which is a different thing.

Is it enough to sign an agreement within the 6 months?

No. HDB measures it by the legal completion date of the disposal, so the sale has to complete inside the window.

Can I sell my HDB flat before my EC is ready?

Yes, once your flat’s own MOP is over. You will need somewhere to live in between, since HDB’s extension of stay is limited to 3 months and needs a completed property.

My parent also owns a flat listed in my application. Does it count?

HDB says you or any person listed in the application must dispose of any interest in any HDB flat, so yes.

Do I pay ABSD if I am still holding the flat when I buy the EC?

Not on a new EC if any purchaser is a Singapore Citizen. IRAS fully remits it, automatically, when HDB approves the acquisition.
