Executive Condominium Rules After You Buy: MOP, Renting Out, Selling and Your Next Home
The EC is a hybrid. You buy it from a developer, but HDB attaches conditions: a Minimum Occupation Period before you can sell, limits on private property and renting, a time you must dispose of an HDB flat, and a resale levy if you later buy a subsidised flat. Here are the rules, from HDB's page.
Minimum Occupation Period (MOP)
- EC units in projects where the land sales tender closed on or after 8 May 2026: can be sold on the open market only after a 10-year MOP, counted from the Temporary Occupation Permit (TOP) date.
- Other ECs: the MOP is 5 years.
- Core occupiers (those who enabled the household to qualify) must stay in the application and physically live in the unit during the MOP, and cannot be listed in an HFE letter to buy another HDB flat or developer EC during it.
If you own an HDB flat
You or anyone listed in the application must dispose of any interest in an HDB flat within 6 months from key collection of the EC, based on the legal completion date of the disposal. See selling an HDB flat and the temporary extension of stay if you need time.
Renting out
- Whole unit: allowed after the MOP.
- Rooms: no prior HDB approval is needed within the MOP, but you must register the bedroom rental with HDB within 7 days, and notify HDB when you renew, terminate or change tenants.
Rental income is taxable; see rental income tax.
Private property
You may invest in private residential property only after the MOP. See HDB owners buying private property for the parallel rules on flats.
Buying your next home after selling the EC
After disposing of an EC on the open market, what you must satisfy depends on what you buy next:
| If you apply to… | Private property condition |
|---|---|
| Buy a flat from HDB, a resale Plus or Prime flat, a resale unclassified or Standard flat with CPF housing grant(s), take an HDB loan, or buy another developer EC | You must not own or have an interest in any local or overseas private residential property, and must not have disposed of any in the last 30 months (from legal completion) before the HFE letter or EC application |
| Buy a non-subsidised resale unclassified or Standard flat (with or without the Proximity Housing Grant), or a short-lease 2-room Flexi flat or Community Care Apartment | If you own private residential property at HFE letter application, you must dispose of it within 6 months of completing the flat purchase |
| Buy private residential property | Not applicable |
Resale levy
When you sell an EC bought with the CPF Housing Grant, or from a project where the EC tender closed on or after 9 December 2013, you are liable to pay a resale levy if, after waiting 30 months, you then buy a subsidised flat from HDB or an EC from a developer. The levy is $55,000 for families and $27,500 for singles, payable when you take the second subsidy. If you buy a resale flat without grants or a private property, you do not pay it. See the resale levy guide.
Citizen Top-Up
If you are in an SC/PR household and a PR family member becomes a citizen, or you have an SC child, you may apply for a $10,000 Citizen Top-Up.
