Can HDB Owners Buy Private Property? MOP, Keeping the Flat and ABSD

HDB owners can buy a condo or landed home, but not at any time. During your flat's Minimum Occupation Period, you, your spouse and your occupiers cannot even exercise an option on a private property. After MOP, what you can do depends on whether any owner is a Singapore Citizen. And separately from HDB, IRAS stamp duty may apply.

The restriction during MOP

HDB says that during the MOP of your flat, the flat owner, spouse and occupiers are not allowed to acquire private residential property. That includes exercising an Option to Purchase or signing a sale and purchase agreement, whether the property is under construction or ready for possession. It covers local and overseas private property.

How the MOP is measured for this purpose

The clock runs from the date you take possession of the flat (including later total changes of owners) to the earlier of: the date you exercise the OTP for the private property, or the date of the sale and purchase agreement. It excludes periods when the whole flat is rented out, periods of non-occupation, and any infringement of the lease.

How you got the flatMOP
From HDB or on resale: unclassified or Standard flats5 years
From HDB or on resale: Plus and Prime flats10 years
DBSS flat from a developer5 years
Fresh Start Housing Scheme20 years
SERS replacement flatsDepends on when the site was announced; commonly 5 years from key collection

You can check whether you have met the MOP on MyHDB Page. Reading MOP: what are your options helps you compare buying private with the other choices.

Can you keep the HDB flat?

Stamp duty is a separate question

HDB's rule and IRAS's ABSD are different regimes. Owning an HDB flat generally counts toward your property count for ABSD, so buying a second residential property can attract ABSD at your profile's second-property rate. IRAS gives remission in defined cases, such as a married couple who sell the first property within the deadline, and applies a different treatment where HDB's own rules require you to dispose of a flat. Read the ABSD guide and the remission deadline guide before you commit, and add BSD.

FAQ

Can I buy a condo while I still own my HDB flat?

Only after you have completed the flat's MOP. After that HDB places no limit on the number of private properties, and Singapore Citizen owners may keep the flat. ABSD and loan limits are separate.

Does the MOP rule apply to my spouse and occupiers too?

Yes. HDB says the flat owner, spouse and occupiers are all restricted during the MOP.

Can I buy an overseas property during MOP?

No. HDB's restriction covers private residential property locally or overseas.

Do I have to sell my HDB flat after buying private property?

Not if at least one owner is a Singapore Citizen and the MOP has been met. If all owners are PRs, you must sell within 6 months.

Does time spent renting out my flat count towards MOP?

No. HDB excludes periods of renting out the whole flat and non-occupation from the MOP calculation.
